Respected Sir,

 

We lodge this present complaint where the perpetrator BSF jawans allegedly tried to kill one Indian civilian namely Mr. Abdulla Gazi, from District-North 24 Parganas, West Bengal by hitting him with a knife. Our fact finding revealed that cattle smuggling going on by the smugglers with the help of the perpetrator BSF personnel when the incident happened and the victim was reportedly working as a carrier of cattle at that time. Further information has been received that the victim had to be admitted in a nursing home in Bangladesh under compelling circumstances. The present incident again brought fore the unholy nexus between a section of BSF stationed at border area and the smugglers.  

 

At present the family of the victim has no clue about his whereabouts. The family of the victim filed written complaint to trace out the victim before the Superintendent of Police, North 24 Pargans, but till date no action has been initiated. The victim's family is still anxiously waiting for his return.

 

Hence we seek urgent intervention of the commission in the following manner:-

  • The whole matter must be enquired into by a neutral investigating agency.
  • The perpetrator BSF jawans must be booked under the law for their alleged criminal offence by registering the allegations brought against them by the victim's family.
  • The respective authorities must be directed to take immediate steps in order to trace out the whereabouts of the victim.
  • Any other relief/reliefs as the Commission deems fit and proper.

Particulars of the victims: - Mr. Abdulla Gazi, son of late Chamchel Gazi, aged about-27 years, by faith-Muslim having permanent residence at village- Gunrajpur, Police Station-Swarupnagar, District-North 24 Parganas, West Bengal, India.

 

Particulars of the perpetrators: - The involved BSF jawans (Battalion-152, Company-E) posted at Gunrajpur BSF BOP Gate no. 14 and 15 on 25.8.2011 at about 3.30 hours under Police Station-Swarupnagar, District-North 24 Parganas

 

Place of incident: - The place of incident is located between Gunrajpur BSF BOP Gate no. 14 and 15 under Police Station-Swarupnagar, District-North 24 Parganas

 

Date and time of the incident: - On 25.8.2011 at about 3.30 hours and thereafter

 

Case Details:- It is revealed during the fact finding that the victim's family consists of his wife, two children and his aged mother. The victim runs the family by working as a day-lablourer in farming lands. He was sometimes engaged by smugglers to transport cattle by crossing over the Indo-Bangladesh border and he by doing such job used to earn money. 

 

On 25.8.2011at about 3.30 hours the victim was engaged by the smugglers to transport cattle to Bangladesh. The smugglers with the help of a section of BSF personnel posted at Gunrajpur BSF BOP. They were smuggling cattle from a shed located between Gunrajpur BSF BOP Gate no. 14 and 15. Suddenly a commotion took place between the involved BSF personnel and the smugglers on Bangladesh side and the involved BSF personnel started firing. As a result a Bangladeshi boy namely Laltu who was in Indian Territory at that time received bullet injury on his leg. He immediately entered into the nearby village and the some local people took him to hospital. It is also revealed that during the incident the involved BSF jawans hit the victim on his lower abdomen by a knife and left him to die on the spot. One person namely Mr. Mostafa Baidya, son of Mojam Baidya residing in the same village of the victim saw the victim in injured condition and  took him to the nearest safe place which was a village under Bangladesh Territory. Then some persons of the said village admitted him in a nursing home in Jashore, Bangladesh. The said Mr. Mostafa Baidya subsequently told the said incident to the victim's wife Ms. Selima Gazi and one Mr. Khalek Sardar, son of Mr. Ebtullya Sardar also told the incident to the victim's wife.

 

Our Fact Finding reveals that one Mr. Jitendra Singh, Company Commander of 'F' Company, 120 Battalion filed one written complaint at Swarupnagar police station on 25 August 2011 at 9.15 PM ( after about 18 hours of the incident) accusing 1) Mr. Laltu Mondal of Bangladesh and 2) Mr. Abdulla Gazi by which Swarup Nagar PS case number 216 of 2011 was registered under sections 147 / 148 / 149 / 186 / 353 / 332 / 307 of Indian Penal Code & 14 Foreigners Act & 12 Passport Act.

 

It is revealed during our fact finding that one person namely Mr. Arshad (his mobile no. 9735765905) from Sultanpur, Bangladesh reportedly helped the victim to get treatment and he perhaps know the present position of the victim.  

 

But the victim's wife could not make any contact with her husband till date and she has no clue about the whereabouts of her husband. She even does not know whether he is still alive or not. Due to poor economical condition she can not search for her husband in Bangladesh. She and other family members of the victim are anxiously waiting for his return. At the present the family of the victim is in hand to mouth condition and the victim's aged mother took up begging to somehow run the family.

 

The victim's wife Ms. Selima Gazi lodged written complaint before the Superintendent of Police, North 24 Parganas against the perpetrator BSF personnel, but till no action has been taken.
