Nikhil Kanekal New Delhi: The Supreme Court placed a temporary stay order on the process of returning land to farmers in Singur on Wednesday, throwing out of gear the West Bengal government's enthusiastic operations to return the acquired land to farmers. However, the court did not go into the details of a new controversial law enacted by the West Bengal legislature as the Calcutta high court is still hearing the case.
"As an interim measure we direst the West Bengal government not to allocate land to the persons concerned till further orders of the high court," ordered the court's vacation bench comprising justice P. Sathasivam and A. K. Patnaik.
Tata Motors Ltd can breathe a sigh of relief after the Supreme Court's intervention given that it has faced the brunt of the state government after it was dispossed of the land on night of 21 June, and the government began the process to return the land to the farmers from whom it was acquired.
"The position must be frozen. Everyday they are going on changing the position. The high court has been hearing the interim issue for the last seven days and everyday the government is doing whatever they want. This is the respect they have for the court," contended Mukul Rohatgi, Tata Motors' lawyer.
However, the company clarifed its position in the apex court saying that it was currently only challenging the return of land to the farmers and not the Singur Land Rehabilitation and Development Act 2011. The constitutional validity of the Act is being contended by the company in the Calcutta high court, where the high court did not grant any interim relief.
But Rohatgi also argued that the government's actions were in bad in law.
"It is settled law that when land is acquired and public purpose is established there is no question of reverting the land," he said.
The state government's counsel told the Supreme Court that the administration was only in the process of determinining the allocation of the land and it was not physically handing over the property to the farmers yet. He said this would first have to be determined by a committee in order to settle any objections.
"I can't do it until the high court committee hears their claims. Unless they decide these objections, they cannot retuen the land," said the state's counsel P. P. Rao.
Tuesday evening, the state government's officials began the process of returning a token 11.5 acres out of the 997.97 acres land to 12 farmers who had unwillingly parted with their land.

"Today, everything (on Singur land) is happening at night," senior advocate Mukul Rohatgi , appearing for Tata Motors', said.
He made the remarks while accusing West Bengal government of coming out with a legislation in a haste for taking possession of the land in Singur for returning it to the farmers who were the original owners.
"At the midnight of June 21, we (Tata Motors) were dispossesed of the land," he said and criticised the Mamata Banerjee government of forcefully taking away the land.
The senior advocate and former Additional Solicitor General charged Trinammol Congress with scuttling the legal remedies available to Tata Motors by saying that when it came to know that the matter will come for hearing today, it allocated land to 13 persons on Tuesday.
"Within 24 hours after it came to know that the matter is coming up for hearing, the state government continued with allocation of land to farmers," he claimed.
However, West Bengal government rubbished the allegation and said everything was taking place in accordance with the due process of law.
The state government had come out with Singur Land Rehabilitation and Development Act on June 21.
We did not abandon the Singur project: Tata Motors
KOLKATA: Tata Motors today told the Calcutta High Court that it had not abandoned the Singur project as stated by West Bengal government and claimed it was forced to leave due to blockades and agitation.
Challenging the state government's enacting a law to take back land from Tata Motors Ltd for return to 'unwilling' farmers at Singur, its counsel S Mitra submitted before Justice Saumitra Pal that it has been wrongly accused of abandoning the land.
He submitted the question of maintainability of the TML petition, which was raised by the Advocate General, was not right.
Advocate General Anindya Mitra had earlier stated that while TML had expressed apprehension that the land would be taken away by the government, the ground reality was that the land was already in possession of the government.
The government had after notifying the Singur Rehabilitation and Development Act 2011 taken possession of the 997.97 acre that had been acquired for the Nano car project in 2006.
Opposing this, Mitra said while the petition was prepared on the evening of June 21 and moved the next morning, the land had been taken in possession by the government from 9:30 pm on June 21.
The matter was adjourned for the day and would be heard again tomorrow.
