The government on Tuesday approved disinvestment of 10 per cent equity each in mining companies Coal India Ltd and Hindustan Copper Ltd.

The decision was taken at a meeting of the Cabinet Committee on Economic Affairs that was presided over by Prime Minister Manmohan Singh.

"Disinvestment of Coal India Ltd would be through book building process in the domestic market. One per cent of the equity will be offered to the employees of Coal India Ltd and its eight subsidiaries," Home Minister P Chidambaram told reporters after the CCEA meeting.

The Committee also decided to allow five per cent price concession to retail investors and employees of Coal India Ltd (CIL). The paid up equity capital of CIL is Rs 6,316.36 crore and the government owns 100 per cent stake in the coal major.

For the disinvestment of Hindustan Copper Ltd, there will be a fresh issue of equity to extent of 10 per cent of the pre-issued paid up capital.

"In conjunction with the issue of the equity, government will also disinvest its 10 per cent pre-issued paid up capital of the company (Hindustan Copper)," Chidambaram said.

Coal India had been looking to launch its offering by August, although a government official recently told Reuters that a September listing was planned.

The stake sales in Coal India and Hindustan Copper are part of a government plan to offload minority holdings in 60 state firms in coming years. The government aims to generate 400 billion rupees ($8.5 billion) via stake sales in state firms in this fiscal year, although persistently weak markets could make that a difficult target.

 

Meanwhile, mocking the ANAND Attempt to prove UnionCarbide INNOCENCE,a 12-year-old Indian-American activist tried to issue summons for Warren Anderson, former chief of Union Carbide over the deadliest 1984 gas disaster in Bhopal.

"Today we are here to appeal to Warren Anderson and summon him to the Indian court where he has been charged with culpable homicide, which is the equivalent of manslaughter in America," Akash Viswanath Mehta said, standing outside a skyscraper on Park Avenue, which houses the law firm that represents Union Carbide.

Mehta, along with his older brother Gautama, 15, were asked to leave the premises by the building owners who said it was private property owned by H J Kalikow. The media was also not allowed to film on the property.

Akash who had the 1992 summons along with a criminal chargesheet in an envelope requested that the package be delivered to the legal offices of Kelly, Drye and Warren. The owners of the building responded that there was no one in the office and the activists should make an appointment or send the summons by post.

"Do you know they represent the CEO of a corporation that is absconding from justice in Bhopal India?" said Adrianne Raff Corwin, an activist from the International Campaign for Justice in Bhopal (ICJB).

"He is being charged with culpable homicide... they are protecting a man who is basically responsible for murdering thousands of people in India and he should be extradited from America," she added.

"It is not necessary for me to be able to understand you," responded the building representatives who refused to identify himself.

The protest was organised by ICJB and Kids for a Better Future based in New York. The two groups noted that their objective was to remind that Anderson was still absconding and needed to respond to the outstanding charges.

When the summon bearers were told to leave, Akash read out a statement to a handful of building owners and cops. By the end of the demonstration the number of police officers had increased from one to six.

"Twenty-five years ago Warren Anderson escaped arrest and his day in court. I would like today to appear to Warren Anderson's conscience, his guilt and his grief and ask him to stand beside me," Akash said.

"If he is truly haunted by the disaster that happened on his watch, which destroyed an entire community I ask him to come forward and make a moral statement about what the right thing is for Dow and Union Carbide to do", Akash added.

"According to American law the polluter must pay and so Dow the owner of Union Carbide must pay to clean up its mess" he said.

On the same day, another demonstration was organised outside the Indian embassy in Washington. "Because the Indian Prime Minister has not taken adequate action to ensure that these parties show up in court, activists are taking it into their own hands to provide summons," the activists said.

In India, seven managers of the subsidiary company Union Carbide Indian Limited (UCIL) were sentenced to two years in prison and fined Rs 2000. Its parent company Union Carbide maintained that it was not subject to the jurisdiction of the Bhopal court since none of its officials were involved in operation of the plant.

"Union Carbide and its officials are not subject to the jurisdiction of Indian court since they did not have any involvement in the operation of the plant," the company said in a statement.

Dow Chemicals, which bought Union Carbide in 1999, asserts that there is no outstanding liability since a 470-million-dollar out-of-court settlement was reached with the Indian Government in 1989.

The US has made it clear that it will not extradite him to stand trial in India.

"I don't expect this verdict to reopen any new inquiries or anything like that. On the contrary, we hope that this is going to help to bring closure," said Robert Blake US assistant secretary of state for South Asia, last week after the sentencing.

The activists also called for the Obama administration to reverse its position that extraditing Anderson would have a chilling impact of investment in India.

"If they're refusing to extradite an American CEO to India, then British Petroleum (BP) and the government of the UK can refuse to cooperate when that case comes up for trial," Robert Mooney, a ICJB supporter and anthropology professor at New York University.

Mooney was referring to the BP oil spill in the Gulf of Mexico, which has been coined as one of the worst environmental disasters. "I'm sure the American public won't stand for that, why should Bhopal survivors get any less," he said.

"That is one of the biggest tragedies, even though its the worst industrial disaster in human history because it's in the poorer country it is virtually unknown," said Akash.

"No-one really knows about it. It appears in the news for a week or so when it happened and then people just forgot about it."

"I have been teaching at New York University since 2002 and each year there is dwindling awareness among my new students because they've never heard of it because they were born after it happened" said Mooney. "But the disaster is still ongoing so they should know about it."

US, India to hold high level talks next week

Washington Close on the heels of a highly successful Indo-US Strategic Dialogue early this month, as many as five Union Ministers are scheduled to visit US next week to hold series of talks with their American counterparts.

"The visit of the five ministers, following closely on the inaugural meeting of the US-India Strategic Dialogue in Washington, underscores the energy and enthusiasm both sides attach to continuing our efforts to strengthen the US-India partnership across a wide range of sectors," State Department spokesman, P J Crowley said.

The US is hosting a high-level delegation of Indian ministers for a series of meetings at the end of this month,

he said, adding that these are follow up to the Indo-US Strategic Dialogue early this month, which were co-chaired by the External Affairs Minister, S M Krishna and Secretary of State, Hillary Clinton.

"Deputy Chairman of the Planning Commission, Montek Singh Ahluwalia, Finance Minister Pranab Mukherjee and Commerce Minister Anand Sharma will be attending the US-India CEO Forum on June 22," Crowley said.

"Union Minister for Health and Family Welfare, Ghulam Nabi Azad will be in Washington and Atlanta from June 23 to 25 for the US-India Health Dialogue," Crowley said.

Minister of State for Science and Technology, Prithviraj Chavan is scheduled to be in Washington on June 24 and 25 for the US-India Science and Technology Forum," Crowley said.

India Inc warns on RBI's knee-jerk reaction

The government's top economic managers on Monday dropped strong hints that the Reserve Bank may raise key policy rates to check spiraling inflation
, even as the India Inc said the central bank must desist from any knee-jerk moves.

The RBI—is slated to announce its quarterly review of the annual monetary policy on July 27—may effect a 0.25% hike each in its repo and reverse repo rates overnight lending and borrowing rates) well before the policy, experts said.

According to Bank of Baroda chief economist Rupa Rege Nitsure, "Inflation is not coming down structurally and demand for foodgrain is growing substantially. I feel that RBI will have to raise rates by 25 bps even before the policy."

There are expectations that the RBI—in the face of tight liquidity conditions owing to 3G auction and advance tax outgo—may resort to hiking only the reverse repo rates and may leave the repo unchanged until cash flows ease in the system. "Yes, we do see possibilities (of pre-policy rate hike). Inflation being where it is, there is a chance of rate hike before the policy." Ashutosh Datar, an economist with IIFL, said.

Tight liquidity conditions have already pushed up the short-term rates while on the other side, banks have also indicated that lending rates in the system will move northward on another round of rate hike from the RBI.

Meanwhile, leading business chambers, who are divided over their outlook for inflation, however, want the Reserve Bank to maintain adequate liquidity to oil growth.

Ficci secretary-general Amit Mitra said, "this is possibly the worst phase of inflation...It is the lean season as far as agricultural supplies are concerned. Once the new crop comes into the market, we can expect inflation in primary articles to come down."

However, Assocham secretary DS Rawat said the common man will face further hardships. "In the first half of the year, inflation will surely go up further due to rising input costs. We will not be surprised, if it increases to 13-14%," he said.

Driven by spiralling prices of essential items, the inflation, measured by the wholesale price index surged to 10.16% in May, the highest in the past 19 months.

Mitra, a well-known economist, noticed a disturbing trend of the spiral in the manufacturing sector as well. "Another emerging source of worry is the build-up of inflation in certain segments of the manufacturing sector," he said, adding the central bank should not use policy tools to cool off demand as he feels the problem lies with the supply side.



Dow liable for clean-up: Law Ministry

A law ministry note in 2008 clearly said that Dow Chemicals is liable for cleaning up the toxic Bhopal site. Despite this, Dow Chemicals claimed that the Indian government gave it an assurance that it is not liable for the clean-up.

The law ministry note says:

"The ministry of law... has observed that irrespective of the manner in which UCC has merged or has been acquired by Dow Chemicals, if there is any legal liability, it would have to be borne by Dow Chemicals."

However, Dow spokesman Scot Wheeler told NDTV on Sunday that Dow Chemical has never had any presence in Bhopal nor does the company have responsibility for any liability relating to Bhopal.

Wheeler says Dow has sympathy for the victims and the solution to their problem was in the hands of the Indian central and state governments.

He also said that when Dow acquired the shares of Union Carbide Corporation in 2001, it was with the understanding that Union Carbide had settled its civil liability with the Indian Government. 

Warren Anderson getaway: The Delhi stopover

A crucial point of the controversy over the Bhopal Gas Tragedy verdict has been the exit route offered to Warren Anderson, who was the American CEO of Union Carbide Corporation (UCC) in 1984 when a gas leak from the company's plant choked Bhopal. (Read: Bhopal Tragedy: Who is Warren Anderson?)

Anderson's departure from Bhopal was not a stealthy one. He flew out on December 7, hours after landing in Bhopal, on the official plane of the Madhya Pradesh Chief Minister, Arjun Singh.  He then stopped in Delhi before leaving the country. But the verdict delivered last week, which offered a nano-punishment to seven Carbide executives, all of them Indian, has led to a new public anger pivoted on why Anderson has never faced trial. The Congress was in power in both Madhya Pradesh and at the Centre, with Rajiv Gandhi, in 1984. Twenty five years later, the party is being forced to mine the past to determine who should take the blame for Anderson's exit. Arjun Singh, seems the general consensus. Several senior leaders, including Finance Minister Pranab Mukherjee, have said the decision to fly Anderson out of Bhopal was made by the state government. But what sort of role did the union government play as Anderson edged out of the country, never to return? (Read: Bhopal tragedy: Justice strangled by successive governments?)

Gandhi's close aide, Arun Nehru, tells NDTV that Anderson, in Delhi, met with Home Minister Narasimha Rao and the President of India. "My assessment from subsequent events and from what we are seeing - obviously Anderson was not a priority on the 7th. This is common sense to me because  the next day, he comes to Delhi and then he meets the Home Minister and then he meets the President. And then, what the media is speculating about... indicates that it is the Foreign Secretary of the time ...whether he was involved or not, I don't know...whether he arranged the interviews with the Home Minister and the President, I don't know. That is for you to find out. But the fact is... Anderson by what happened on the 7th or the 8th was not considered a criminal at that stage. So this is what logic indicates." So why was Anderson treated like a visiting foreign dignitary, with the protocol and privileges accorded to a VIP?

Tarlochan Singh, who was Personal Secretary to Giani Zail Singh, explains why the President might have met Anderson, who was by then charged with culpable homicide amounting to murder. "If any foreigner wants to meet the President, it's done through a government department. One needs the recommendation of a Central government department to facilitate such a meeting. Secondly, for any such meeting, the department officials accompany the foreigner. And an interpreter is also present."

Bhopal tragedy : Complaint filed against Arjun Singh

A complaint has been registered against veteran Congress leader and former Madhya Pradesh Chief Minister Arjun Singh over his alleged role in the release of former Union Carbide Chairman Warren Anderson, the prime accused in the 1984 Bhopal Gas Tragedy, who was allowed to leave the country soon after the catastrophe.

Advocate Furkhan Khan, who has filed a complaint in Chief Judicial Magistrate (CJM) R G Singh's court, has demanded the registration of a criminal case against Singh for permitting Anderson to flee to the United States in a wrong manner.

Meanwhile, a separate complaint has been filed against former Bhopal Collector Moti Singh and Superintendent of Police (SP) Swaraj Puri on the charge of facilitating the safe exit of Anderson.

The court will take up the matter for argument on June 29 following which it will decide whether the complaints are acceptable for hearing or not.

Anderson was arrested on December 7,1984, when the deadly methyl isocyanate (MIC) gas leak from Union Carbide's Bhopal plant.

The gas leakage had killed thousands of people just five days ago.

Singh is believed to have ordered the release of Anderson, but opposition parties allege that he was instructed to do so by the then Central Government led by former Prime Minister Rajiv Gandhi.

Anderson was charged with culpable homicide not amounting to murder, grievous assault and killing and poisoning human beings and animals.

A District Magistrate's Court in Bhopal had on June 7 convicted all eight accused on grounds of negligence under Section 304 (a) for the tragedy.

The court also granted bail to seven of the eight accused and released them on submission of a bond and a surety of Rs 25,000 each.

The eight accused are Keshub Mahendra, Vijay Gokhle, Kishore Kamdar, J Mukund, S P Choudhary, K V Shetty and S I Qureshi and R B Roy Choudhary.

Out of the accused R B Roy Choudhary, then former Assistant Works Manager Union Carbide India Ltd (UCIL), Mumbai, died during the trial.

Anderson has been designated an absconder. (ANI)

Whiff of Afghan treasure

June 14: The US has discovered nearly $1 trillion in untapped mineral deposits in Afghanistan, far beyond any previously known reserves and enough to fundamentally alter the Afghan economy and perhaps the war itself, according to American officials.

The value of the newly discovered mineral deposits dwarfs the size of Afghanistan's existing, war-bedraggled economy with a gross domestic product of about $12 billion. The estimated value of the deposits almost matches India's GDP of $1.2 trillion.

The discovery adds a stunning economic dimension to the Great Game, a strategic joust straddling centuries. India is also part of the ongoing Great Game but does not have much of a presence in mining in Afghanistan now. Locational disadvantages, too, stand in the way of India exploiting the sector, unless Iran offers passage.

At the same time, American officials fear a resource-hungry China will try to dominate the development of Afghanistan's mineral wealth.

The previously unknown deposits — including huge veins of iron, copper, cobalt, gold and critical industrial metals like lithium — are so big and include so many minerals that are essential to modern industry that Afghanistan could eventually be transformed into one of the most important mining centres in the world, the US officials believe.

An internal Pentagon memo, for example, states that Afghanistan could become the "Saudi Arabia of lithium", a key raw material in the manufacture of batteries for laptops and BlackBerrys.

The vast scale of Afghanistan's mineral wealth was discovered by a small team of Pentagon officials and American geologists.

While it could take many years to develop a mining industry, the potential is so great that officials believe it could attract heavy investment even before the mines are profitable, providing the possibility of jobs that could distract from generations of war.

"There is stunning potential here," Gen. David H. Petraeus, commander of the US Central Command, said. "There are a lot of ifs, of course, but I think potentially it is hugely significant."

The mineral deposits are scattered throughout the country.

American and Afghan officials agreed to discuss the mineral discoveries at a difficult moment in the Afghanistan war. The American-led offensive in Marja in southern Afghanistan has achieved only limited gains.

Charges of corruption and favouritism continue to plague the Hamid Karzai government, and Karzai seems increasingly embittered towards the White House.

So the Obama administration is hungry for some positive news. Yet, the American officials also recognise that the mineral discoveries will almost certainly have a double-edged impact.

Instead of bringing peace, the mineral wealth could lead the Taliban to battle even more fiercely to regain control.

The corruption that is already rampant in the Karzai government could also be amplified by the new wealth, particularly if a handful of well-connected oligarchs gain control of the resources.

With virtually no mining industry or infrastructure in place today, it will take decades for Afghanistan to exploit its mineral wealth fully.

Modi ad row hijacks BJP meet agenda

Patna The controversy surrounding Gujarat Chief Minister Narendra Modi over two advertisements virtually hijacked the two-day party National Executive that ended on Sunday.

The resolutions and the debates at the conclave took a backseat with the row involving Modi and his Bihar counterpart Nitish Kumar taking the centre stage following the ad blitzkrieg praising the Gujarat Chief Minister.

In one advertisement Modi was shown holding a hand of Kumar and another listing the details of Gujarat government's aid to Bihar during the Kosi floods in 2008.

This riled Kumar no end that he cancelled a dinner he was to hold for the top BJP leadership on Saturday night.

Kumar, who is heading a coalition government with BJP, is wooing Muslims in the elections scheduled later this year and does not want to be seen in the company of Modi.

Perhaps, no other crucial meeting of the BJP had revolved around one man, relegating the issues challenging the organisation.

There was a sense of unease in a section of party leaders even before the meeting as Modi left no stone unturned to project his larger-than-life persona with some advertisements depicting him as a "Hindu Hriday Samrat" and some others claiming that Muslims were well-off in Gujarat.

The maiden visit of Modi in Bihar after becoming was preceded by a propaganda which provided fodder for the detractors of Nitish Kumar to target him ahead of Assembly elections in Bihar.

This came as an apparent embarrassment to Kumar, who has been assiduously wooing the Muslims, constituting 16 per cent of the state's population.

Nitish Kumar utilised the national media, which had come to cover the BJP meet, to send the message loud and clear to Modi as also the BJP top brass that he was not amused by the tactics of the Gujarat Chief Minister.

The manner in which Kumar went about the task made the BJP leadership rally around Modi with party chief Nitin Gadkari telling his party that the need of the hour is to behave as a "mature national political party" which would not compromise on self-respect for power-sharing.

Modi himself made the right noises, winning many supporters in the process. He was the toast of the "Swabhiman" (self-respect) rally yesterday where BJP launched its election campaign for the assembly elections to be held in October- November.

Several supporters were seen carrying Modi posters and raising slogans in his name. They responded enthusiastically to his overtures to them. He raised the tempo with slogans like "Bharat Mata ki Jai" and "Vande Mataram".

Modi also kept away from the raging controversy, leaving it to senior BJP leader L K Advani to send across a message to the Bihar Chief Minister that the advertisements were not such a big issue and he would have been happy to see Kumar at the rally.

Modi utilised the occasion to target Congress President Sonia Gandhi, asking her to speak up on who was the "merchant of death" in the Bhopal gas tragedy which had claimed over 15,000 lives in 1984.

It was Sonia who had used the term "merchant of death" against Modi in the 2007 assembly elections in Gujarat. Modi also spoke on national issues like price rise, terrorism and farmer suicides.

That the BJP top brass stood behind Modi despite feelers from Nitish that he should not speak shows the clout Modi holds among the BJP pantheon.

India asks Pak to 'shed its insecurity'

Emphasising that as the two countries commence the exercise of overcoming the difficulties in the relationship, it was important to reiterate a few points, Foreign Secretary Nirupama Rao said India seeks a stable, peaceful and economically progressing Pakistan.

"Secondly, we sincerely desire peace with Pakistan. Thirdly, we have to learn to live with the asymmetries in our sizes and capabilities. Such differences of scale should not deter us from working with each other. Pakistan should shed its insecurity on these counts," she said.

Despite "misguided and serious provocations", India has exhibited true restraint, Rao said.

She asked Pakistan to prevent the entry of radical ideology into the domain of religion, and, the consequent implications for peace and security between India and Pakistan, making differences over Kashmir even more difficult.

Radical, terrorist forces are also increasingly battling for larger space in a deadly struggle that seeks to overwhelm moderate, democratic forces in Pakistani civil society, the Foreign Secretary said.

"The writing on the wall must be seen," she said.

Terrorism as a continuation of war by other means and the use of terrorist groups selectively as strategic assets against India cannot and must not continue, she said.

"As an intrinsic part of the long-term vision of relations it desires with India, Pakistan must act effectively against those terrorist groups that seek to nullify and, to destroy the prospects of peace and cooperation between our two countries," Rao said in her address at the Afghanistan-India-Pakistan 'Trialogue' organised by Delhi Policy Group yesterday.

The last 60 years have had more than their share of bitterness, recrimination, mistrust, misunderstanding and miscommunication, where these two countries are concerned, she pointed out.

"The road ahead is a long and winding one. But as fellow travellers, India and Pakistan must tackle the challenges of this rocky road with the belief that a secure and prosperous future vitally and crucially depends on our ability to do so."

The remarks come ahead of the meetings between the Foreign Secretaries this month and Foreign Ministers next

month who have been directed by their respective Prime

Ministers to work out the modalities of restoring trust and

confidence in the relationship thus paving the way for a

substantive dialogue on all issues of mutual concern.

RComm to hive off Infratel as separate biz

Mumbai Close on the heels of announcing that it will divest up to 26% in the company, Reliance Communications Ltd (RComm), which has a total debt of Rs 33,000 crore on its books, on Monday said it will restructure its ownership in its telecom towers arm, Reliance Infratel Ltd, to bring in new investors and improve financial flexibility.

The boards of RComm and its subsidiary, Reliance Infratel approved a proposal to restructure the former's ownership through a demerger, thereby creating 'the world's largest independent telecom infrastructure company, not owned and/or controlled by any telecom operator'.

RComm's residual 95% stake in RTIL is valued at $6.40 billion (Rs 26,000 crore). The company has a current tenancy ratio of 1.7. Both firms are in advanced stages of discussions with several domestic and international strategic and financial players to finalise the proposal for a stake sale, and a transaction is expected to be announced shortly. GTL, Crown Castle and American Tower Company (ATC) are the likely front-runners in picking up a stake in Infratel, sources said.

"This transformational proposal will be implemented through demerger or other suitable value creating options vis-a-vis Infratel's assets, subject to necessary approvals, with the consideration to be received in a combination of cash and stock," RComm said in a media statement.

Currently, Reliance Infratel has 50,000 towers and is expected to increase this number to 75,000 towers in the span of three years.

"A change in ownership will allow service operators to use their network, leading to increase in tenancy ratio of Infratel. However, there is no clarity as to how much of the 95% stake RCom is giving up," said an analyst on the condition of anonymity.

The move will lead to substantial reduction in RComm's consolidated debt and improved leverage ratios for the company, contributing to enhanced financial flexibility.

Reliance Infratel had planned an IPO of shares as long ago as in February 2008, but the public issue is yet to hit the market.
