NHRC recommends Rs. 25,000/- each as monetary relief to three convicts, victim of inhuman treatment in prison in UP
New Delhi, January 30th, 2012
The National Human Rights Commission has recommended that the Uttar Pradesh Government pay Rs. 25000/- each to three prisoners who were severely ill treated by the prison authorities in district Bhadoi of the State.
The Commission had taken suo motu cognizance of media reports in this regard on the 23rd August, 2011 and sought reports from the State Government.
In response to Commission's notices, Additional I.G. (Administration) along with a report from DIG (Prisons), Allahabad Range informed that the then In-charge jail, Deputy Jailor and two warders were found responsible for causing inhuman treatment to the prisoners. An FIR was also registered against them. A Departmental enquiry was also recommended in the matter.
Responding to Commission's further proceedings in the matter, the State Government informed that some of the jail warders were departmentally punished. A request was also made to the medical department for initiating action against jail medical officer.
From the reports the Commission found it clear that three convicts namely Suresh @ Suraj, Rajkumar @ Chhotu and Raj Bahadur Yadav were severely ill treated with their legs tide with a rope and they were kept hanging up side down. The State Government had also requested the Commission that till the departmental proceedings against the erring jail staffers were completed, the monetary relief to the victims may not be granted.
However, the Commission, convinced by the fact that some erring officials were already punished departmentally and magisterial inquired had indicted several jail officials; the grant of interim relief to each victim is justified.
The Commission on the 19th January, 2012 directed the State Government through its Chief Secretary to send the proof of payment made to the victims within four weeks.
