भूमि अधिग्रहण एवं पुनर्वास कानून 2011 के प्रारुप पर NAPM के सहयोगी संगठनो एवं सहयोगियों को राष्ट्रव्यापी अभियान का आह्वाहन

प्रियजनों, 

            आज देश के सामने भूमि अधिग्रहण एवं भ्रष्टाचार दो ऐसे महत्वपूर्ण राजनीतिक मुद्दे हैं जिनसे समूचा देश जूझ रहा है। प्राकृतिक संसाधनों एवं मानव शक्ति पर निर्भर आबादी एवं आम लोगों के लिए निश्चित रुप से यह जीवन के संघर्ष का सर्वाधिक महत्वपूर्ण उद्देश्य है। महत्वपूर्ण क्षेत्र सिद्धांत, principle of eminent domain (1894 भू अधिग्रहण कानून) के आधार पर भूमि एवं उससे जुड़ी तमाम चीजों को राजकीय संपत्ति घोषित कर दिया गया है। उपरोक्त कानून सरकार को सार्वजनिक उद्देश्य के नाम बलपूर्वक अधिग्रहण करने का भी अधिकार प्रदान करता है। वर्ष 1984 से संप्रभु सरकारें इस कानून का उपयोग निजी कंपनियों के लिए भूमि अधिग्रहण करने में भी कर रही हैं और इस प्रकार इन सरकारों ने देश कृषक वर्ग, ग्रामीण एवं शहरी समाज के खिलाफ अन्यायपूर्ण संघर्ष की शुरुआत कर दी है। सार्वजनिक हित के नाम पर खनिज एवं जलीय संपत्ति का भी अभूतपूर्व दोहन किया जा रहा है। जिसका अनुचित लाभ इससे संबद्ध लोगों को मिल रहा है। इस गंभीर परिस्थिति ने एक ऐसे तीव्र संघर्ष की स्थिति उत्पन्न कर दी है जिससे आदिवासी, दलित, किसान, मछुआरे, मजदूर जैसा हर वर्ग जुड़ा है जिसे विकास के नाम पर पीड़ित किया गया है। निर्वासित कर दिया गया है और अधिकारों से वंचित रखा गया है। 

 

            3 अगस्त से 5 अगस्त तक NAPM ने विभिन्न राज्यों के 50 अन्य जनसंगठनों के साथ संघर्ष के बैनर तले आयोजित राष्ट्रीय अभियान में शिरकत किया (http://sangharshblog.wordpress.com/)। यह बैठक भूमि अधिग्रहण एवं विस्थापन एवं पुनर्वास विधेयक के प्रारुप के प्रकाश में आयोजित किया गया जिस पर ग्रामीण विकास मंत्रालय ने 31 अगस्त तक आम लोगों के विचार आमंत्रित किये है। प्रास्तावित प्रारुप में यह दावा किया गया है कि यह कानून पंूजीवादी ताकतों से निरंतर संघर्ष का परिणाम है। हालांकि यह कानून मुख्य विषयों को पूरी तरह से अनदेखा कर रहा है और विकास जनति समस्याओं से प्रभावित लोगों के राहत में यह पूर्णतया अक्षम है। 

 

            हम लोग विकास नियोजन के कानून की मांग कर रहे हैं न कि अधिग्रहण कानून की जिसका अर्थ अधिग्रहण और अधिकार प्राप्त करना है। और पूर्व के अनुभवों से यह ज्ञात होता है कि प्रायः अधिग्रहण बिना किसी पूर्व सूचना के और आम लोगों की इच्छा के विरुद्ध बल पूर्वक किया जाता है। इसके बावजूद की भूमि इस समाज के जीविका का एक मात्र श्रोत है। उनकी इच्छा एवं विचारों से अवगत होना आवश्यक नहीं समझा जाता। चूँकि यह कानून देश के विकास की जरुरतों की बात कर रहा है तो यह आम लोगों को ही निर्णय करने दिया जाये कि देश को किस तरह के विकास की आवश्यकता है। 

 

            जब 4 और 7 अगस्त को संघर्ष के प्रतिनिधि नए ग्रामीण विकास मंत्री श्री जयराम रमेश से मिले तो हमने उन्हें अपनी तमाम चिंताओं से अवगत  कराया। हमने माननीय मंत्री से यह कहा कि सरकारी परियाजनाएं ही सबसे ज्यादा त्रुटीपूर्ण हैं और किसी भी परियोजना की शुरुआत में ग्राम सभा एवं बस्ती सभा की सहमति आवश्यक होनी चाहिए। ठीक इसी प्रकार नए कानून में उन विस्थापितों के लिए भी राहत एवं पुनर्वास के प्रावधान होने चाहिए जो विभिन्न परियोजनाओं से पहले से ही प्रभावित है और जिनके पुनर्स्थानपर एवं पुनर्वास की व्यवस्था अब तक नहीं की गई है। हम श्री जयराम रमेश के हाल के दिये गए वक्तव्य का स्वागत करते हैं कि प्रस्तावित कानून अतीत में आरम्भ हुई योजनाओं पर भी लागू होगा एवं  किसी सरकारी परियोजना से प्रभावित होने वाले लोगों की रजामंदी को भी ध्यान में रखा आएगा एवं उन्हें अपने विचार देने के लिए आमंत्रति किया जाएगा। हालांकि हम यह फिर से कहना चाहते हैं कि हमारा संघर्ष  प्राकृतिक संसाधनों पर निर्भर लाखों समुदायों के भूमि एवं जीविका संबंधी अधिकारों की रक्षा के लिए है, न कि भूमि अधिग्रहण के लिए जिसका लक्ष्य 8 और 10 प्रतिशत के विकास दर को प्राप्त करना  है। 

 

            हमारे संघर्ष का उद्देश्य जल, जंगल, जमीन, खनिज एवं मेहनत पर आम लोगों का अधिकार स्थापित करने के लिए है। एक तरफ हम विस्थापन एवं भू अधिग्रहण की किसी भी प्रक्रिया का पूरजोर विरोध कर रहे हैं तो दूसरी तरफ हम कानूनी प्रक्रिया में भी अपनी दखलंदाज़ी जरूरी समझते हैं ताकि हर कानून हमारे संघर्षो के लिए एक उचित हथियार बन सके. हमारा कहना है कि नये विधेयक को ग्रामीण एवं शहरी दोनेां समस्याओं का निदान करना चाहिए और :

 

1.            विकास योजना को तरजीह दी जानी चाहिए जिसका आशय ऐसी योजना से है जो समानता एवं न्याय के सिद्धांतों पर आधारित हो। योजना निचले स्तर से ही लागू होनी चाहिए जिसमें ग्राम सभा एवं बस्ती सभा की भूमिका होनी चाहए जैसा कि संविधान के अनुच्छेद 243 और इसके अन्दर 72वें एवं 73वें संशोधन में प्रावधान है। 

2.            ऐसी संभावनाओं की तलाश की जानी चाहिए जहाँ कम से कम विस्थापन हो और वह भी सिर्फ सार्वजनिक  परियोजनाओं के लिए, जहाँ पर परियोजना से प्रभावित लोगों के अधिकार  को मान्यता हो और सार्वजनिक योजनाओं से प्राप्त लाभ में उनकी पहली हिस्सेदारी हो. 

3.            भूमि एवं जीविका के अधिकारों की रक्षा, अनुचित लाभ के उद्देश्य से किये जा रहे कृषि भूमि के अधिग्रहण पर रोक एवं सार्वजनकि हित के नाम निजी हित साधने के लिए किए जा रहे जमीन अधिग्रहण पर रोक लगे.

4.            नए परियोजनओं की शुरुआत तब तक न की जाए जब तक उससे जुड़े समुदाय की स्वतंत्र एवं पूर्व सहमति न प्राप्त हो जाए। भूमि, जल, जंगल एवं खनिज का अधिग्रहण तभी किया जाए जब समुदाय द्वारा इसकी सहमति प्रदान की जाए।

5.            और विस्थापित तब तक न किए जाए जब तक कि पूर्व से विस्थापित लोगों का पुनर्वास की व्यवस्था न हो। प्रस्तावित परियोजना से विस्थापित होने वाले लोगों की पुनर्वास का प्रबंध किया जाना चाहिए।

6.            पर्यावरण की क्षति न हो इसके लिए योजनाओं को सही एवं समयबद्ध क्रियान्वयन होना चाहिए। परियोजना के सभी पर्यावरणीय प्रभावों का ठीक-ठीक पूर्व निर्धारण होना चाहिए।

 

विधेयक के प्रारुप पर 31 अगस्त तक विचार आमंत्रित किये गए हैं। इस संदर्भ में संघर्ष ने यह निर्णय लिया है कि निम्नांकित कार्यक्रमों को अतिशीघ्रता एवं शक्ति तथा उत्साह के साथ आरंभ किया जाना है।  हम NAPM के सहयोगी संगठनो से यह निवेदन करते हैं कि वे इसमें हमारा सहयोग करें एवं हमारे संयुक्त प्रयास में भागीदार बनें। 

 

1.            विस्तृत परामर्श कार्यक्रम का आयोजन - राज्य एवं क्षेत्रीय स्तरपर हमारे संघर्ष के अनुभव के आधार पर एक विस्तृत सुझाव तैयार किये जाएँ जो की मंत्रालय को 31 तारीख के पहले दिया जा सके. अब तक NAPM सदस्यों ने निम्नांकित परामर्श की योजना बनायी है: अगस्त 12 - नागपुर (विलास भोंगाड़े 9890336873), अगस्त 17 - मुंबई (सुनीति स र 9423571784), हैदराबाद - अगस्त 19 (रामकृष्ण राजू 9866887299), बंगलोरे (सिस्टर सलिया 9945716052), बिहार (आशीष रंजन झा 9973363664), धिनकिया, उड़ीसा - अगस्त 26 जुलाई (प्रफुल्ला समान्तर 9437259005), नर्मदा घाटी (श्रीकांत 9179148973)     

2.            तत्काल बातचीत की शुरुआतः  नए कानून और इसके संदर्भ में हमारे दृष्टिकोण जो कि उन संगठनों, संबंद्ध नागरिक समूहों, शोधकर्ताओं, कार्यकर्ताओं एवं अन्य बुद्धिजीवियों से आमंत्रित किये गए हैं।

3.            हमारे विचारों का प्रसार-समाचार पत्रिकाओं, समाचार पत्रों एवं अन्य मीडिया माध्यमों के द्वारा ।

4.            संबंधित विषय पर अन्य संगठनों द्वारा आयोजित किए गए कार्यक्रमों में प्रतिभागिता एवं उनमें हमारे विचारों की प्रस्तुति।

5.            जन हस्ताक्षर अभियान की शुरुआत: नए कानून से जुड़ी हमारी चिंताओं का स्पष्ट प्रकटीकरण जिसे लिखित में ग्रामीण विकास मंत्री श्री जयराम रमेश  को भेजा जाएगा। पताः श्री जयराम रमेश, ग्रामीण विकास मंत्री, कृषि भवन, नई दिल्ली-110001, ईमेल- jairam54@gmail.com

6.            जैसा कि दिल्ली में निर्धारित किया गया, 25 अगस्त को हमारे सहयोगी संगठनों द्वारा भूमि हक्क सत्याग्रह का आयोजन किया जाएगा और जिसमे भूमि, जल, जंगल, खनिज तथा जलीय संपदाओं पर हमारे अधिकारों के दावें को सुदृढ़ता के साथ प्रस्तुत किया जाएगा। विकास की संपूर्ण दिशा को परिवर्तित  कर उसे 'आम  लोगां के संसाधनों पर आम लोगों का अधिकार' के सिद्धांत पर लागू किया जाएगा ताकि इन संसाधनों से आम लोगों का विकास हो सके।

 

इस बीच संघर्ष के प्रतिनिधियों के एक समूह द्वारा विधेयक से जुड़े बिंदुओं पर एक विस्तृत टिप्पणी तैयार की जा रही है जो कि हमारे पास लगातार आ रही, विभिन्न आंदोलनों से जुड़े व्यक्तियों के विचारों को भी ध्यान में रखेगी।

 

हम अपने संघर्ष के एक अत्यंत ही महत्वपूर्ण पड़ाव पर खड़े हैं जहाँ हम अपने संयुक्त प्रयासों से एक सफल विकास नियोजन के कानून को पारित करा सकते हैं विस्थापन एवं भू अधिग्रहण के खिलाफ अपनी लड़ाई लड़ते हुए एवं प्राकृतिक संसाधनों के ऊपर सामुदायिक अधिकार स्थापित कर सकेंगे ।

 APPEAL FOR NATION-WIDE MASS ACTION

to NAPM associated members and supporters

On

 Draft Land Acquisition and Resettlement and Rehabilitation Bill, 2011

 

New Delhi, August 10, 2011

Dear all,

 

'LAND ACQUISITION' is the key issue on the political agenda, today along with 'corruption'. For the common people and the communities living on the natural resources and human power, it certainly is the most important reason for their battle for survival. 'Land and everything attached to the land' was declared as the state's property under the principle of eminent domain (1894 Act) and hence available for forcible acquisition, for government projects in the name of public purpose. Since 1984, the sovereign governments of India used it for acquiring land for private companies too and thereby launched and legitimized an unjustifiable war against the agrarian communities, habitats in the urban and rural habitat areas and also began an unprecedented transfer of minerals and aquatic wealth from the public to the profiteers.  All this has led to intense struggles by the adivasis, dalits, farmers, fish workers, toiling masses and all who are deprived, displaced and victimsed in the name of development.

 

From August 3^rd to 5^th, NAPM along with nearly 50 mass people's organisations from more than 10 states participated in the national action organized under the banner of SANGHARSH [see http://sangharshblog.wordpress.com/ for details]. We met in the backdrop of new Draft Land Acquisition, Resettlement and Rehabilitation, 2011 brought out by the Ministry of Rural Development, which is seeking feedback from citizens, till 31^st August. This draft claims to be a result of martyrdom and committed battles of the communities which has held on to their land and prevented the capitalist forces marching over them. However, the Bill fails to address the core concerns of the communities and their reasons for resisting the current development paradigm, even though it does have some progressive provisions providing relief to the project affected people.

 

We The People, are demanding a Development Planning Law NOT an acquisition law, which means 'to acquire; to take control' and experience shows it has always been forced, without complete prior information, consent and knowledge of impacts of the communities who own it or are dependent on it for their livelihood. The complete paradigm has to change and since the Bill tries to address the development needs of the country, let people plan and decide the kind of development country needs.

 

We conveyed to Honourable Minister Jairam Ramesh our larger concern on these issues but also stressed that government / public projects have been the biggest defaulters and Gram Sabha and Basti Sabha consent is must for public projects too and, similarly the new Bill have to address unfulfilled resettlement and rehabilitation entitlements of already displaced people due to various projects when the Sangharsh delegation met with the new Minister, Shri Jairam, Ramesh on August 4^th and subsequently on August 7^th. We welcome his recent statement that the new Bill would be applicable with retrospective effect and also the consent would be sought from the project affected people for government projects as well. However, we would like to reiterate that our struggle is to protect land and livelihood rights of the millions of the natural resource based communities and not to facilitate acquisition for mindless 8-10% growth obsessed development paradigm.   

We have struggled along with many movements in the country for establishing the community control over jal (water) jangal (forests), jameen (land), khanij (minerals) and of course, mehnat (hard work) of millions that recasts all of this into 'development'. As we  continue to do so, we also feel that the laws which facilitate transfer and acquisition of these resources in the hands of private and public corporations for profitable exploitation need to be resisted and every struggle geared towards changing them and making them a tool for our struggle. 

 

WE ASSERT THAT THE NEW ACT SHOULD ADDRESS CONCERNS AT RURAL AND URBAN AREAS BOTH AND :

 

1.    FOCUS on development planning means planning which is based on the principles of equity, minimum need and distributive justice and the plans must evolve from lowest unit plan, keeping in view the role of gram sabha / Basti Sabha as provided under the Constitution in the article 243 or under the 73^rd and 74^th Amendments.

·         EXPLORE options with no displacement or least displacing alternatives to projects for truly public purpose.

·         ADMIT community rights to resources and their involvement in planning as well as their first share in the benefits accruing out of the projects for public purpose

·         PROTECT land and livelihood rights in rural and urban areas both and stop all diversion of agricultural land and no acquisition for profiteering and private interest of anyone in the garb of public interest.

·         NOT IMPOSE new projects or plans on a community or their land, water, forest and minerals acquired unless their free, prior and informed consent is obtained.

·         NOT CAUSE further displacement without prior and complete resettlement and rehabilitation of the project affected people with housing, civic amenities and alternative livelihood.

·         NOT LEAD to irreversible environmental degradation and any inevitable environmental impacts must be fully assessed beforehand and plans for mitigation of the same be formulated, approved and executed in a timely manner.

 

The draft Bill is open for comments till 31^st August. It is in this context that all the participating organizations at the Sangharsh dharna, New Delhi have decided to take up the following programme with utmost urgency, fullest possible mobilization in spirit and strength. We urge our members and supporters to join this call and collectively bring our efforts together.

 

1.    HOLD DETAILED CONSULTATIONS, at the state-level and regional level, drawing on the experience of our collective struggles, on the provisions of the Bill and prepare our detailed response to the proposals of the Ministry. As of now following consultations are being planned by NAPM members : Nagpur – August 12 (Bilas Bhongade 9890336873), Mumbai - August 17^th (Suniti S. R 9423571784), Hyderabad - August 19^th (B Ramakrishna Raju 9866887299), Bangalore (Sister Celia 9945716052), Bihar (Ashish Ranjan 9973363664), Dhinkia, Orissa – August 26^th (Prafulla Samantara 9437259005), Narmada Valley (Shrikanth 9179148973). Some of our fraternal organisations are also organizing consultations in different parts of the country, we shall circulate the information as we get it. 2.    INITIATE IMMEDIATE DIALOGUE on the theme of new bill and our visions inviting people's organizations, concerned citizen's groups, researchers, activists and other intellectuals in your state.

3.    SPREAD OUR VIEWS through magazines, news papers or any other media.

4.    JOIN IN THE PROGRAMMES being conducted on the theme by other organisations and explain our position on this.

5.    ORGANISE MASS SIGNATURE CAMPAIGN in all rural and urban states and regions clearly stating our concerns and assertions with respect to the new bill and send it to the Shri Jairam Ramesh, Ministry of Rural Development, Krishi Bhawan, New Delhi 110001; E-mail: jairam54@gmail.com

6.    As decided in Delhi, we also call upon all our associated organisations to organize BHUMI HAQ SATYAGRAHA on August 25^th and assert our claim to land, water, forest, minerals and aquatic wealth which is lying vacant and not allotted to the needy and demand a total change in the development paradigm towards 'PEOPLE'S RIGHTS TO PEOPLE'S RESOURCES' thereby acknowledging people's development plans with those resources.

 

Meanwhile, a small team comprising of many of the constituents of Sangharsh collective are working on developing more detailed critique of the Bill, which will also take in account the concerns we are constantly receiving from different movements and individuals.

 

We are standing at an important juncture of our struggles, resisting displacement and claiming land and livelihood rights and we all need to put together our collective strength towards a comprehensive development planning bill.
