Senior telecom official to probe divestment of VSNL
S.R. Rao, additional secretary in the Department of Telecom ( DoT), has been named to head the probe on matters relating to the divestment of state-run Videsh Sanchar Nigam Ltd ( VSNL) in favour of the Tatas.
The probe, according to officials, will deal with two aspects: The delay in separating the surplus land held by the former state-run company following divestment in 2001 and if the Tatas secured any undue favour in landing the deal.
The probe report on what was the erstwhile international telecommunications arm of the government has been asked by March 31.
The government had earlier invited consultants to advise on the valuation of some 775 acres of surplus land in New Delhi, Pune, Kolkata and Chennai that was earlier with the state-run enterprise, prior to holding an auction to sell it, officials said.
The Tatas have already welcomed the probe.
"Tata Communications welcomes any government process that will hopefully expedite the demerger of surplus land, which we have repeatedly requested in the best interests of the company and its shareholders," said the group.
"We categorically deny that Tata Communications or the Tata group has benefited or seeks to derive benefit from the surplus land," the group said in a statement.

"It is not correct to say that all these cables are mere opinions by US diplomats, that is not true," Assange told a news channel in an interview telecast Monday.
"These are official correspondence sent by ambassadors, sent in their official capacity... They report what they say are facts, and they also present opinions. It's important to keep these two different," he said.
"In the case of the Indian cable which is causing such a furore about bribery, it is very hard to understand why any US embassy official would lie to Washington...
"The comment I have been hearing from Prime Minister (Manmohan) Singh, these, to me, seem like a deliberate attempt to mislead the public by suggesting that governments around the world do not accept the material and it is not verified... absolutely false!
"There is no doubt these are bonafide reports sent by American ambassador to Washington and these should be seen in that context. That does not mean every fact in them are correct," he said.
Assange's comments follow the uproar in India after an American embassy cable leaked by WikiLeaks quoted an aide to a Congress leader as saying that money was paid to some MPs -- and more were to be paid -- to win support for Manmohan Singh's government in parliament in July 2008.
The government has denied the allegation. Government leaders have also said that the leaked cables carry no authenticity and cannot be verified.
Assange argued that if this was true, then US diplomats in India can be accused of lying.
"If this cable on bribery is incorrect, then the US ambassador in India has a lot to answer for because he has been sending back very serious reports to Washington about senior politicians and (their) behaviour in Indian parliament, which casts it in very negative light.
"It would affect the relationship between India and the US," he said. "So he has committed a grave error."
Assange, an Australian, said there was "an attempt to distort the record and fool the public about the nature of the material.
"First, they refused to comment at all, (then) to suggest the materials are not verified and no other government accepted it. Absolutely false...
"This is actually the behaviour of guilty men. Man who is innocent doesn't tend to behave like that.
"That doesn't mean people making those statements like Prime Minister Singh are guilty of this particular crime.
"It suggests something that how Indian parliamentarians and politicians respond to very serious allegations.
"They respond through indirection and attempting to cover up the issue for the public, rather than address it fully and frankly."
WikiLeaks accessed over 200,000 US diplomatic cables from an American soldier who is now in jail.
However, the BJP today tried to turn the tables on the UPA saying it will have to conduct an inquiry into its own conduct on the issue of delay in hiving off the VSNL and return of 773 acres land to the Government.
"One of the ministers is trying to put the NDA in the dock on the VSNL ( Videsh Sanchar Nigam Limited )) demerger issue but the inquiry will be in the Government's own deeds as it will have to explain what was being done by P Chidambaram and Pranab Mukherjee (past and present Finance Ministers) in the last six years," Prakash Javadekar said in Rajya Sabha.
He was participating in the debate on the Finance Bill, 2011.
Raising concerns over the disinvestment of VSNL in 2002, Telecom Minister Kapil Sibal had recently said, "It has come to my notice that the disinvestment of VSNL in 2002 does not seem to be fair and transparent" and ordered an inquiry into the deal.
The VSNL disinvestment was done in 2002 during the NDA regime.
In response to the minister's allegations, former Disinvestment Minister Arun Shourie, under whom VSNL was sold to Tatas, had also said that if there was any delay in the demerger of the land, a probe should be ordered against the past and present Finance Ministers in the UPA government.
The issue was also raised earlier by V Hanumantha Rao (Cong), who cited media reports to pinpoint alleged irregularities in disinvestment of VSNL to the Tatas during Shourie's tenure as Disinvestment Minister in the then NDA government.
"This is a fit case for investigation by CBI," he said triggering protests from BJP members.
Attacking the Government, Javadekar said the Finance Minister had presented a budget which was "lackadaisical and uninspiring" and didn't have much to offer to the poor and unemployed youth.
Taking part in the debate, T Subbarami Reddy (Cong) said the Government had not announced any populist scheme despite the fact that elections were being held in five states.
On the Polavarm power and irrigation project in Andhra Pradesh, he said it was a national project and wondered as to why the government was not coming forward to get the project completed.

Amid a raging controversy over disinvestment of the erstwhile VSNL, Tatas on Thursday hit back at the government, saying the company made several attempts since 2005 onward for the demerger of surplus land but the Telecom Ministry's response is still awaited.
In a letter to Telecom Minister Kapil Sibal, Tata Communications Chairman Subodh Bhargave gave a summary of the sequences of events since 2005, which also have concurrence of two directors nominated by the government.
Tatas' letter comes in the wake of Mr. Sibal raising concerns over the disinvestment of VSNL in 2002, saying, "It has come to my notice that the disinvestment of Videsh Sanchar Nigam Limited (VSNL) in 2002 does not seem to be fair and transparent."
"Prima facie, the way issue of demerger of 773.13 acres of surplus land of VSNL was handled in 2002 and thereafter, not only the interests of investors but also the interests of the government seems to have been adversely affected," Mr. Sibal said in an internal note asking Telecom Secretary R Chandrashekhar to constitute a high-level committee to examine the issue in detail.
The Tatas, however, said "The surplus land remains secured and unused by the company, waiting for a resolution of the demerger issue. The company continues to bear the expenses toward the surplus land's upkeep and security as well as associated property taxes."
More officially, Mr. Bhargava said, the company has been unable to raise any non-debt funding during the last few years to support its investment and growth aspirations due to the non-resolution of this issue.
In fact, former Disinvestment Minister Arun Shourie, under whom VSNL was sold to Tatas, had also said that if there was any delay in the demerger of the land and if a probe has to be ordered, "it should be against P Chidambaram and Pranab Mukherjee, the past and present Finance Ministers in the UPA government in past seven years."
Shourie had defended the disinvestment, saying stringent conditions were laid down that prohibited the sale of surplus land by winning bidders.
Bhargava said that the company has participated in a few discussions and received some correspondence on surplus land, but those have been mostly in nature of seeking clarifications and the "DoT response to the draft scheme of demerger is still awaited."
"You (Sibal) would agree that the demerger of this surplus land is waiting for the government's response on the matter. You should also recognise that the Board of Tata Communications has two directors nominated by the government and they are apprised of all these issues," Bhargava said in the letter.
Tata Communications would be "more than willing to share all the facts with you or any officer deputed by you to look into the matter. More importantly, we welcome a speedy resolution of the demerger issue in the best interests of the company and all its shareholders."
