Sources privy to the investigation said Uber's General Manager (Marketing) Gagan Bhatia, who claims to be the in-charge of the company's India operations, during his day-long questioning, has not been able to provide much information to the police regarding the company's operations and its policies.

  

Bhatia could not come up with satisfactory answers to these questions posed by police and he has been asked to produce the documents regarding the operations of the company in India.



Did Prime Minister Narendra Modi's summit meeting with US President Barack Obama in September signal a paradigm shift in bilateral ties? Was it a ground-breaking moment in Indo-US ties that had seen a slump over the years? Experts, including former diplomats, do not think it was a paradigm shift, but agree the visit was trend-setting and helped reignite US business interest in India.

No wonder,New Delhi's ban on the US based ride-sharing service Uber following the rape of woman passenger by one of its drivers has focused attention on the fights it's engaged in with local governments around the world, including in San Francisco where it was accused of misleading customers into believing they banned drivers with criminal backgrounds.

"It's not the first time that Uber drivers have been accused of sexual assault," noted the Time magazine.

The ride-sharing service has also faced bans at one point or another in cities across the world, and many disputes with authorities remain unsettled, it said.

The "war chest" of the $41.2 billion San Francisco based company doing business in 45 countries, "will come in handy" in these battles, Time suggested.

In San Francisco and Los Angeles, district attorneys have accused the ride-sharing service of misleading customers into believing they ban drivers who have ever committed criminal offenses, the newsmagazine noted.

Time listed at least five places where Uber is facing government pushback.

In Portland, Oregon, Uber began operating illegally on Friday night and could face penalties, according to the city's transportation bureau.

A court challenge against Uber in the Netherlands resulted this week in an injunction against the ride-sharing service, with a court saying the company can't work with drivers who don't have a license, Time said.

In September, courts in Berlin and Hamburg ruled the company did not comply with German laws and officially banned the service from using unlicensed taxi drivers, according to the magazine.

In Toronto, Canada, authorities argued last month that Uber is "jeopardizing public safety" and is getting ready to fight the ride-sharing service in court, Time said.

Uber halted operations in Nevada after it issued a statewide ban against the service last week, with a court arguing the company operates like a taxi business.

Uber has also "come under fire for what some consider a lax attitude toward protecting the private data of its customers and ensuring passenger safety," according to the Washington Post.

The UberPop service, which links clients with drivers who do not have professional licenses, has been banned in the Netherlands and the German cities of Berlin and Hamburg, according to the New York Times.

London's main taxi association has brought lawsuits against Uber and a number of its drivers, it said.

Lawmakers in Thailand and Vietnam have banned the service, and the city government in Seoul has said it plans to do the same.

However, writing "in defence of Uber in India" in Fortune, a columnist suggested "Uber with its use of technology is way safer than any other cab company or any generic cab driver who hustles you at the airport."

"What really happened here is a tragedy due to India's inherent social dynamics and problems with sexual assault as well as its inability to have a efficient ID system," he wrote.

"*That* is why a young woman was harmed and that's what we should be focusing the spotlight of mainstream attention on," the columnist suggested.

It's an icon that many click on without ever bothering to actually read what they are agreeing to. But with Uber facing the heat for the alleged rape of a woman in one of its cabs, the terms and conditions that it asks its customers to agree to online while utilising its services make for interesting reading.

There, the company absolves itself completely of all responsibility and liabilities arising out of the misconduct of drivers including situations that are "potentially unsafe, offensive".

"Uber does not guarantee the suitability, safety or ability of third party providers. It is solely your responsibility to determine if a third party provider will meet your needs and expectations…. By using the services, you acknowledge that you may be exposed to situations involving third party providers that are potentially unsafe, offensive, harmful to minors, or otherwise objectionable," says the user terms of Uber.

It's not just Uber though, other operators too have fallen back on similar lines when it comes to liability.

Meru's terms and condition states, "The Company shall not be liable / responsible for any illegal conduct of the Drivers of the Cabs. However, the Company recommends you to notify about any complaints that you may have against the Drivers of any Cab."

But what's really different in the case of Uber is that it is not an entity registered in India — it runs a business and generates revenue from the country without having a legal presence here. Also, the agreement that customers enter into while accepting the terms and conditions of Uber is with Uber B.V The Netherlands and Uber Technologies, Inc The United States. Even the bill generated by Uber is from UBER B.V.

Legal experts have offered differing opinions on Uber's operations in India.

Sandeep Parekh of FinSec Law Advisors said there was nothing wrong with the company operating without being registered in India since they only have an App.

But another legal expert, who did not wish to be named, said that ideally the company should not be operating in such a manner and that this issue involves other jurisdictions too.

For customers who want to take legal action against Uber for lapses in service, the company's terms and conditions state that one can file a case against the company in the jurisdiction of his/her place of residence but also clarifies that the total liability in connection with services for all damages shall not exceed $500 (Rs 3,000).

And in case of any arbitration, the arbitration will be administered by American Arbitration Association.

The RBI had earlier questioned the fact that Uber was not following the mandatory two-step security check for credit card transactions.

An RBI official told The Indian Express that when the transaction is between two entities (passenger and cab driver) based out of India then there was no reason for the money to go abroad as it involves forex transaction.

The company, however, has now begun to comply with the norms, said the RBI Deputy Governor H R Khan on Monday


Senior Congress leader Shashi Tharoor, however, said he did not see any tangible result from Modi's US visit, rather it was a "damp squib" and there was "very little beyond the blather" to contribute to bilateral ties.

Former foreign secretary Lalit Mansingh, addressing a panel discussion on 'Modi-Obama Summit: A paradigm shift in India-US Relation' at the University of Chicago Center here Monday evening, said that Modi's visit was trend-setting and helped repair the damage to bilateral relations of the past four years.

"The visit brought back the fizz to bilateral relations, and the mood to US business about India," said Mansingh at the seminar partnered by the Indo-American Friendship Association. He added that around $40 billion worth of transactions were inked following the Modi visit.

According to Mansingh, the "ground-breaking moment" in bilateral ties was the inking of the civil nuclear deal between then prime minister Manmohan Singh and George Bush in June 2005.

Tharoor, who is chair of the Parliamentary Standing Committee on External Affairs, said he did not think that the intensive engagement between the Obama and Modi governments in the last six months has resulted in "much substance, unprecedented or paradigm shift" in bilateral ties.

According to him, the US is not impressed by the "big soundbytes" of Modi and "What they are looking for is action not words, results not hype. And that's what we are looking forward to in India too, and we havn't seen enough of that."

"When that happens, there will be substantive change" in ties, Tharoor said.

According to veteran journalist and Rajya Sabha member H.K. Dua, while the Modi invite to Obama to attend the Republic Day Parade next year is a major achievement, the US president would be expecting some returns from India.

"Obama would expect, would like India to be generous in climate change, investments in the defence arena," Dua said, and added that the US has been "holding back" in giving sensitive technology to India.

According to economist Rajiv Kumar of the Centre for Policy Research, India-US relations will improve if the business relations improve. He added that India needs to make the nuclear liability law more accomodative.

Michael Pelletier, US deputy chief of mission, said that bilateral ties are witnessing "a very public engagement to take relations forward" and mentioned the bilateral Defence Technology and Trade Initiative (DTTI), which he said was for co-production with India.

"What is changing is the confidence... the range of visits and talks indicate we are moving forward," the US official added.

According to author Gurcharan Das, the "proof of the pudding is in the business-to-business relations". He said if India can raise its name in ease of doing business, it would add a fillip to ties.

The event was moderated by former diplomat Surendra Kumar, co-founder of the Indo-American Friendship Association, and also addressed by Denise M. Jorgens, director of International House at the University of Chicago.


Baba Ramdev to open chain of schools across India


Dehradun : After spreading his dispensaries in every nook and cranny of India, yoga guru Baba Ramdev is all set to operate his brand of school throughout the country.


So, after popularising yoga, promoting ayurveda and launching an anti-corruption movement, Ramdev is now focusing on changing the education system and giving it a swadeshi colour.


In the first phase, Ramdev intends to open 500 schools deeply rooted in the gurukul pattern of education. For this, Ramdev's flagship project Patanjali Yogpeeth - located in Haridwar, Uttarakhand and one of the largest yoga institutes in India - has invited proposals and sought participatory approach in setting up the educational institutions that will offer a fusion of modern and vedic education.


Ramdev has already established one such school - Aacharya Kulam - in Haridwar and intends to set up its chain across the country.


During the United Progressive Alliance (UPA) rule, Ramdev had applied for affiliation of the school with the Central Board of School Education (CBSE) but is yet to receive the approval. The baba is claiming that he will form an autonomous board far superior to the CBSE.


Ramdev said: "Aacharya Kulam will be a unique school that will train both the students and their parents. With modern education, we will link ancient science. The youths graduating from the school will behave like rishis (sages)."


Advert like edit Ramdev's close aide Acharya Balkrishna has written an editorial on the Aacharya Kulam scheme in "Yog Sandesh" magazine, published by Patanjali Yogpeeth. The editorial is more of an advertisement seeking land and donor details for starting a new fully residential and day-boarding school.


In the write-up, he talks of taking financial support for setting up the new schools from businessman Anil Agarwal who is founder and executive chairman of the UK-based Vedanta Resources.


Balkrishna even claims that prime minister, finance minister, HRD minister, other central ministers and VVIPs may attend the inaugural or foundation stonelaying ceremonies of some big Aacharya Kulam centres.


He said: "Unfortunately, no effort has been made to make the education system purely Indian, swadeshi, purifying it or making it fully scientific. We are making an autonomous board that will be better than CBSE in terms of curriculum. It will also marry modern and vedic education." Ramdev is establishing the Aacharya Kulam Society that will run the schools that will be of two types - fully residential and dayresidential from Classes I to XII.


The yoga guru wants a self-sustaining model with schools operating on no-profit basis.


Parents of the students will also be trained on a weekly basis.


Patanjali Yogpeeth's PRO Dr Vijay Kumar Mishra said: "We have started receiving proposals. Haridwar's Aacharya Kulam has over 400 students."


The main aim of Aacharya Kulam is to prepare proven scholars in grammar, philosophy, upanishad, veda, vedic literature, vedic mathematics, Indian proven history and raj dharma, etc.


It also aspires to prepare graduates with the power to give social, spiritual, economical, scientific and political leadership. In short, it intends to groom leaders for a modern India.


Patanjali Yogpeeth is promising that the names of donors will be displayed on the front gate of the school, letter pad, building and school vehicles.


The minimum land required for residential units has been fixed at 10 acres while two-five acres is needed for day-boarding. Moreover, each person interested in setting up such school has been asked to find another 50-100 donors.
