The Will of the People of Kashmir Must Prevail: Mirwaiz

Geneva, Switzerland. March 11, 2011. "The most tragic aspect of the present situation is the Indian government's refusal to recognize the internationally mandated status of Jammu & Kashmir as a dispute to which there are three parties: India, Pakistan and the people of Kashmir" said Mirwaiz Umar Farooq, Chairman, All Parties Hurriyet Conference (APHC) while addressing an important seminar, entitled, "Defending the Will of the People" during the current session of the United Nations Human Rights Council in Geneva, Switzerland. The seminar was moderated by Dr. Ghulam Nabi Fai, Executive Director, Kashmiri American Council/Kashmir Center.

Mirwaiz elaborated that India will get nowhere by explaining away Kashmir as a 'terrorist problem' created by Pakistan and the forces of Islamic fundamentalism. India's problem of Kashmir will not have gone away simply because the movement in Kashmir is a popular, indigenous and non violent one.

Mirwaiz emphasized to regain much of what has been lost, the people of Jammu & Kashmir are determined to present the peaceful objectives to the international community, led by the United Nations.  Our political consciousness is embodied in 'the All Parties Hurriyet Conference'  and our objective is to determine a peaceful and lasting solution to the conflict through dialogue, with the participation of all parties - Governments of India, Pakistan and the leadership of the people of the State of Jammu & Kashmir. APHC's view is one of inclusion. APHC believes that there is nothing to be gained by isolating groups with varying opinions including minorities.

APHC belives that Kashmir issue cannot be resolved through military might. It is a political issue and has to be resolved through peaceful negotiations. APHC also believes that peace process between India & Pakistan; and killings in Kashmir cannot go together. In this regard, APHC has submitted to the Government of India a proposal to create a conducive atmosphere for dialogue which includes:

1.  The complete withdrawal of military presence from the towns and villages'
2.  The unconditional release of all political prisoners.
3. The immediate repeal of all draconian laws, including 'The Jammu Kashmir Disturbed Area Act' and 'Public Safety Act.'

Mirwaiz reminded the audience that he people of Kashmir need their help in persuading India and Pakistan that Kashmir cannot be resolved bilaterally. The experience of last 63 years proves that all bilateral talks failed because the Kashmiri people were never party to these talks. The time has come that the talks need to be tripartite between India, Pakistan and the Kashmiri leadership.

Dr. Ghulam Nabi Fai said that 'The Will of the People' must prevail in all international situations where the United Nations promised a people a referendum to decide their future but which have not yet been carried out. He quoted to the Article 21 / 3 of the Universal Declaration of Human Rights which states, "The will of the people shall be the basis of the authority of government." Dr. Fai referred to United Nations Security Council resolution number 47 of 1948 which says that the future of Kashmir must be decided in accordance with the wishes and the will of the people.

Dr. Fai said while as the latest uprising in Egypt and Kashmir were both popular and non violent but there was a clear distinction between the two situations. The armed forces in Egypt sided with the people while as the military in Kashmir used the brute force to crush the genuine aspirations of the people for freedom and self-determination.

Dr. Fai mentioned about the disappearances of Ghulam Nabi Khan of Kutlari, Mawar Handwara who was picked up by the Indian Security Forces on July 24, 1996 and did not return till to date. Mr. Khan's daughter, Ms. Aneesa Nabi Khan is attending the current session of the UN Human Rights Council to seek justice from the international human rights bodies as she has lost faith in Indian judicial system.

Mr. Amjad Yousuf said that the will of the people has prevailed in Egypt and Tunisia and it must prevail in Indian occupied Kashmir as well where the people are demanding their right of self-determination for the last more than six decades. The people of Kashmir have paid a heavy price in demanding their ultimate objective - the right of self-determination. Mr. Yousuf emphasized that the revolution of Egpyt became a suceess story simply because it was endorsed by the world powers. He warned the United Nations that the key to stability and progress in Afghanistan lies in the resolution of the Kashmir dispute.

Mr. Ali S. Khan said Egypt seems to have taken a cue from Kashmir. The Kashmir uprising of 2007 until today were not any way less than the Egypt revolution? Perhaps the Kashmiri protests were much shriller and louder than the Arab one. The Lal Chowk (Red Square) in Srinagar had witnessed millions of people demanding freedom from the Indian rule. Unfortunately, the world leaders quickly responded the revolution in Tahri Square (Egypt) but kept mum on Red Square (Kashmir).

Dr. Ahmed  Abdellatti of IIFSo said that the people of Arab world are grabbing their rights in their countries that once were invaded by dictatorial governments. The youth of Egypt, Tunisia and Libya today chose the way of peaceful revolutions that has surprised the world and obliged them to respect their aspirations.  IIFSO expects from the United Nations and Human Rights Council to protect the rights of these people to have free elections, have their freedom and decent life and the free communication with the international community under the rules of justice and equality. Dr. Abdellatti added that IIFSO has introduced a new initiative for youth and students which is based on rehabilitation, training and empowerment to acquire the skills, tools and ideas to act and work with international organizations and networkings of institutions that have been absent for a long time from the environment that has been ruled out by dictators.

Barrister Majid Tramboo said that the time has come the International Criminal Court needs to take serious note of the grave situation in Indian occupied Kashmir. India has given the pledge, Barrister Tramboo added to the people of Kashmir here at the United Nations that they will be allowed to decide the future according to their own free will. This free will cannot be exercised except in an environment which is free from coercion and intimidation. Barrister Tramboo said that the presence of 700,000 Indian military and paramilitary forces have made Kashmir the largest army concentration anywhere in the world which remains a challenge to the conscience of the international community.

The seminar was organized by Los Angeles-based 'International Educational Development' and was jointly co-sponsored by 'Association of Humanitarian Lawyers', 'International Human Rights Association of American Minorities', 'International Islamic Federation of Student Organizations" 'World Muslim Congress', AHRKI, KMMK-G."

Khan, Executive Director, Kashmiri Scanidavian Council, Norway and Barrister Majid Tramboo, Executive Director, Kashmir Center, Brussels.
