Geneva, Mar 11: The Hurriyat Conference (M) Chairman Mirwaiz Umar Farooq Friday reiterated that Kashmir issue cannot be resolved through military might but by peaceful negotiations.
Addressing a seminar titled "Defending the Will of the People" during a session of the United Nations Human Rights Council in Geneva, Mirwaiz said: "The All Parties Hurriyat Conferences believes that Kashmir issue cannot be resolved through military might. It is a political issue and has to be resolved through peaceful negotiations."
Mirwaiz made it clear that the peace process between India and Pakistan and killings in Kashmir cannot go together.
Reiterating his four-point formula on Kashmir, Mirwaiz said the APHC has submitted to the Government of India the proposal to create conducive atmosphere for dialogue.
This, he said, includes the complete withdrawal of military presence from the towns and villages in Kashmir, unconditional release of all political prisoners and the immediate repeal of all "draconian laws" including the Disturbed Area Act and the Public Safety Act.
"India and Pakistan need to be persuaded that Kashmir cannot be resolved bilaterally.
The experience of last 63 years proves that all bilateral talks failed because Kashmiris were never party to these talks. Time has come for a tripartite dialogue between India, Pakistan and the Kashmiri leadership," Mirwaiz said.
He said the most tragic aspect of the present situation is the Indian government's refusal to recognize the internationally mandated status of Jammu and Kashmir as a dispute to which India, Pakistan and the people of Kashmir are a party. "India will get nowhere by saying that Kashmir is a terrorist problem created by Pakistan and the forces of Islamic fundamentalism," he said. "But the fact is that the movement in Kashmir is a popular, indigenous and non-violent one."
Mirwaiz emphasized to regain much of what has been lost. "The people of Jammu and Kashmir are determined to present the peaceful objectives to the international community led by the United Nations. Our political consciousness is embodied in the APHC and our objective is to find a peaceful and lasting solution to the conflict through dialogue," he said. "The APHC believes that there is nothing to be gained by isolating groups with varying opinions including minorities."
The seminar was moderated by the Executive Director of the Kashmir American Council, Dr. Ghulam Nabi Fai. "The will of the people of Kashmir must prevail in all international situations where the United Nations promised a people a referendum to decide their future but which have not yet been carried out," Fai said.
He quoted the Article 21/3 of the Universal Declaration of Human Rights which states that "the will of the people shall be the basis of the authority of government." Dr. Fai referred to United Nations Security Council resolution number 47 of 1948 which says that the future of Kashmir must be decided in accordance with the wishes and the will of the people.

The seminar was organized by Los Angeles-based 'International Educational Development' and was jointly co-sponsored by 'Association of Humanitarian Lawyers', 'International Human Rights Association of American Minorities', 'International Islamic Federation of Student Organizations" 'World Muslim Congress', AHRKI, KMMK-G.
