I am bringing here an incident of ghastly torture by posted Border Security Force personnel upon a person from schedule caste community into your kind notice. The person lost his agrarian lands like many other of the area and in brink of starvation like situation. As the basic state deliverance like employment guarantees for rural poor is in shambles at this part of the country; the affected has no other alternative except involvement with cross border smugglings as mere carrier against a meager amount for their sub human sustenance. The victim here was banished with savage brutality by BSF personnel and till date not in a position to earn bread for him and his family.
Though, I made several complaints regarding physical intimidations and extra judicial killings of persons from marginalized community before the Commission, but due to lack of any effective prosecution of the culprits, they are giving a damn to the law of this country. The magnitude of their wrongdoings has reached an alarming proportion. The victim, Mr. Bharat Mondal was treated by the doctors of VIC-TREE, a project run by MASUM with the assistance of United Nations Voluntary Fund for Victim of Torture (UNVFVT) where his statement was also visually recorded. In this contextual reality I demand:-
- A thorough investigation of the incident by an independent agency
- Errant BSF personnel be booked with specific charges for causing grievous hurt to a person
- Financial compensation for his monetary loss encountered by absence in daily wage earning due to received injuries and medical expenses incurred
- Complete security and protection for the victim, his family and witnesses

Name and other details of the victim: Mr. Bharat Mondal; son of Mr. Kutub Mondal; aged about 40 years; by profession an agrarian labourer and from Schedule Caste community; resident of village- Char Sahebnagar, Post Office- Harudanga, Police Station- Raninagar of Murshidabad district
Name and details of the perpetrators: 4 Border Security Force constables on their camouflage uniform; attached with Mourashi Camp of Chowki number-2 under Out Post-2 of 105 No. Battalion of Border Security Force
Date and Time of the occurrence: 30.12.2011 at around 8 am
Place of occurrence: Agrarian field at Mourashi, near Mourashi Camp of Chowki number-2 under Out Post-2, Post Office- Harudanga, Police Station- Raninagar of Murshidabad district
Case Detail
Mr. Bharat Mondal, an agrarian labourer lost his land in river erosion like his other neighbors. Like many others he has no means of sustain his family of 6 rather involving him with cross border smuggling of cattle. He has a job card under the scheme of Mahatma Gandhi National Rural Employment Guarantee Scheme but not received a single day job out of it. He was a part time cattle rattler or carrier for the smugglers. On 30.12.2011, he arrived at the place of occurrence to smuggle out 7-8 cattle. At about 8 am he was apprehended by the said BSF jawans. Thereafter, the BSF jawans wreaked severe physical torture upon him. He was also stripped in broad day light. Bharat was beaten by riffle butts, sticks and kicked off by boot clad feet of the said personnel. Bharat Mondal was profusely bled from his received injuries and broke his left arm in the process of torment. The BSF personnel left unconscious Bharat to die at the said agrarian field. Ms. Chintamoni Mondal; wife of the tortured Mr. Bharat Mondal while informed about the condition of her husband, came at the place with few of her neighbors and brought Bharat to Godhanpara Block Primary Health Center for treatment. The attending doctor at the said BPHC refered him for Domkal Sub Divisional Hospital or Baharampur New General Hospital. He was admitted to Bahrampur New General Hospital by his family. The victim is still under treatment of a private medical practitioner and not in a position to earn bread for him and his family.
The BSF personnel in other hand warned the family members of the victim and neighbor not to make complaint to police station or divulge the incident before any other. Somehow, the family gathered courage and made a written complaint to the Superintendent of Police; Murshidabad on 23.03.2012 and forwarded a copy of the same to the Officer in Charge of Raninagar police station. Mr. Sri Nath Mondal; son of Mr. Amir Chand Mondal, Mr. Panchanan Mondal; son of Mr. Dhananjay Mondal, Ms. Sumitra Mondal; wife of Mr. Sri Nath Mondal all residents of village- Char Sahebnagar, Post Office- Harudanga, Police Station- Raninagar of Murshidabad district, are witnesses of this ghastly torture upon Mr. Bharat Mondal.
