Republic, under the control of the public

This 26th January, we uphold the constitution in its true spirit, we recall and remember all the fundamental rights given to us by the constitution and the articles to define and establish the public interest.

It's time to remind the State about its duties.

Republic day is the day when the constitution was handed over to the public to adopt and enact our rights and duties. Today even after 62 years these rights still have not reached to all the citizens. The state has proven to be inefficient to play its role, so now the citizens are demanding to recall their elected representatives.

Country is fighting with food scarcity. Farmers are committing suicide. Economic inequality had crossed the limits. Corruption had forced the citizens to come on the roads.

Parliament is not working towards upholding the true spirit of the constitution. Capitalist Market forces have taken over Justice and Equality; displacement and exploitation of the natural resources became high. Participation of the 'Gram Sabha' and 'Ward Sabha' became low in the decision making process of development of the area. Amendments to law related to Land, Water and forest are intended to displace the native population. The Adivasis feels more slavish in the current system than they used to be in the British Period.  As a result, extremist groups started reaching them.

New ports and townships, mega dams, National parks, Sanctuaries, Forest Conservation, Mining, Industries and Special Economic Zones are coming up in the name of so called development and industrialization. By this so called of development capitalist forces are making profit and displacing the native people from their land. Rural- Urban Migration rate is still very high as the capital concentrated itself in the urban areas. No social security for the workers in the cities as well. Labour laws had maintained no such security for the labour force. Cities are witnessing infrastructure development for the rich day by day but at the same time minium basic requirements for the urban poor have decreased.

People prefer costly educational institutions on government education as the level of government educational institutions are very low.

Development and energy are being seen together as a result aims at the nuclear energy, coal energy, thermal energy, hydro energy became higher. Not a single river of the country is without dams.

Development projects and land mafias in both rural and urban areas have grabbed most of the land. Government even supports this kind of action. Due to this entire climate has been changed.

Centralised capital growth has increased unemployment.

We are optimistic that adivasi, women, dalit, fisher folk, workers, hawkers, vendors have started raising their voice. Even the middle class have started raising its voices in some instances.

In this case, 26th January is not just a day to show power performances at the Rajpath but also to uphold the glory of the Constitution. We, call all the movements and struggling groups in the country to celebrate the republic day in its true sense and to read the fundamental rights and articles- 21, 48 A, 51 A, Schedule 243,244, PESA 1996, FRA 2006 on 26th January which protects public interest.

Preamble to the Constitution of India

WE, THE PEOPLE OF INDIA, having solemnly resolved to constitute India into a SOVEREIGN SOCIALIST SECULAR DEMOCRATIC REPUBLIC and to secure to all its citizens: JUSTICE, social, economic and political; LIBERTY of thought, expression, belief, faith and worship; EQUALITY of status and of opportunity; and to promote among them all FRATERNITY assuring the dignity of the individual and the unity and integrity of the Nation; IN OUR CONSTITUENT ASSEMBLY this twenty-sixth day of November, 1949, do HEREBY ADOPT, ENACT AND GIVE TO OURSELVES THIS CONSTITUTION.

The Six Fundamental Rights recognised by the Constitution are:

1) Right to equality, including equality before law, prohibition of discrimination on grounds of religion, race, caste, sex or place of birth, and equality of opportunity in matters of employment, abolition of untouchability and abolition of titles.

2) Right to freedom which includes speech and expression, assembly, association or union, movement, residence, and right to practice any profession or occupation (some of these rights are subject to security of the State, friendly relations with foreign countries, public order, decency or morality, right to life and liberty, right to education, protection in respect to conviction in offences and protection against arrest and detention in certain cases.

3) Right against exploitation, prohibiting all forms of forced labour, child labour and traffic in human beings;

4) Right to freedom of religion, including freedom of conscience and free profession, practice, and propagation of religion, freedom to manage religious affairs, freedom from certain taxes and freedom from religious instructions in certain educational institutes.

5) Cultural and Educational rights preserving Right of any section of citizens to conserve their culture, language or script, and right of minorities to establish and administer educational institutions of their choice; and

6) Right to constitutional remedies for enforcement of Fundamental Rights.

Major Articles in the Constitution

Article '21' of the Constitution provides the right to life and liberty. According to which the state will protect life and livelihood of its citizens.

Article '48 A' ensures protection and improvement of the environment and safeguarding of forests and wild life.

Article '243' says the elected representatives of the Gram Sabha and Ward Sabha will be treated as the assembly and Parliament in the local level for decision making process.

Major Amendments to the Constitution

73rd Constitutional Amendment enhances the powers of the Gram Sabha and Palli Sabha. Without the consent of  the Gram Sabha no development activity will take place. This has been written more prominently in the Schedule 244 of the Constitution. 

74th Constitutional Amendment enhances the powers of the Ward Sabha, the local decision making body in the cities.

Important New Acts

PESA, 1996 gives enormous power to the Panchayats. Right to Information Act, 2005 gave the power to the people to make the system transparent.

Under Forest Rights Act in 2006, Indian state proved its inclination to the forest and forest dwellers.

Come, this 26th January we take the pledge to protect our republic and rights of the people and to build a new nation in this line to restore the true Republic and power of the republic. Inquilab Zindabad
